How would you compare Japanese Royal family with your country's?

Most of Japanese people are loyal supporter.

We love "Koushitsu".

I really think so.

And some of them are rather the cult of Yasukuni.

I myself only have been respecting for our Empress Michiko.

I can't stop sending a longing look at my graceful aging Empress and feel happy
because having the supreme Cinderella story.

Her familiy is not raised to the nobility.

Of course they have been one of super-rich people, but without former nobility.

Far from it、They are famous Catholic laity.

So our nation was more united than ever, more respected and much stronger to our Empress.

Since my visa has already expired, I can't ask the local government for help.


A;

You are eligible for Workmen's Accident Compesation Insurance as Japanese workers.

It doesn't matter whether you visa status is legal or not.

In 1989, the Labor ministry announced,

"Japanese labor laws, including the Labor Standards Law(Rodo kijun-ho 労働基準法）, Workmen's Accident Compensation Insurance(Rodou Saigai Hoken Hosho-ho )and the Labor Safty and Sanitation Law(Rodo Eisei Hoken-ho) protect all people working in Japan, regardless of nationality or visa status."


Employers have a legal responsibility to take out the insurance policy.

Even though you are not insured by the employer, you are still eligible because the compensation insurance is retroactive to the time when you were employed.


In your case, the employer must pay all the premiums for the last three years.


Many illegal workers hesitate to apply for compensation insurance at the Labor Standards Inspection Offices(Rodo Kijun Kantoku-sho) because they are afraid of being reported.

According to the Labor Ministry, the Labor Standards Inspection Offices won't report to the immigration offices in principle, except when they find an excessive number of illegal workers working somewhere.

If you are afraid of being reported to the immigration offices, there are several public consulting offices for foreigners which will maintain discretion.

What do I have to do to organize a labor union?

A;

Even foreign workers have the right to organize a labor union, bargain collectively and go on strike.

These rights are guaranteed by the Constitution of Japan for every worker, regardless of nationality.

#(Right to Organize, Bargain Collectively and Go on Strike)

The Constitution of Japan Article 28
The right of workers to organize and to bargan and act collectively is guaranteed.

In addition, the Labor Union Law stipulates an unfair labor practice system and a labor commitee system to affirm a rights of workers, and it provides for the requirements of a labor union that can be protected by it.

According to the law, the labor union shall be:
1, an organization formed substantinally by workers,

2, independent of the employer, and

3, an organization that operates in a democratic manner(in term of the operating of the union itself as well).

If such requirements are properly met, the labor union can make its presence known, and there is not need to be authorized by any civil authority or report thereto.

The labor union as such shall have at least two members.

The labor union Law Article 2
Labor unions under the present law shall be those organizations, or federations thereof, formed autonomously and substantially by workers for the main porpose of maintaining and improving working conditions and for raising the economic status of workers.

Most Japanese labor unions are company based ones, but there are no legal regulations framing how a labor union may be formed.

Consequently, workers may organize a labor union by region, occupation, or by affiliated companies.

A labor union shall have the right to bargain collectively with the company for which its members work, regardless of the number of members.

There is no system in Japan like the exclusive negotiatuion representative system in the United State of America (where only a labor union that has a majority of workers is endowed with the right to bargain collectively).

The small booklet of every employment rules is distributed to every emplouee, but I can't read it because it is in Japanese.

Can I ask my employer to translate it into in English?

Firm with 10 or more over employees are required to draw up rules of employment and to submit them to the Labor Standards Inspection Office.

The rules of employment must clearly state working hours, holidays, wages and retirement allowances.

As for retirement allowances, eligibility, the methods of calculation and payment should also be stipulated.

If there are a bonus, compensation and welfare systems for employers are obligated to clarify them in the rules of employment.

The Labor Standards Law requires employers to post the rules of employment in a prominent place and make them understandable to the employees.

Therefore you can demand, and your employer must provide, an English version of the employment rules.

Although you are staying in Japan with a "student" resident status, as long as you work, you are a worker as well.

You are, of course, under the protection of the labor laws, and you can expect support from a labor union.

The simplest way is to obtain membership in a joint labor union, which you can join as an individual, and negotiate with your employer.

There are not many joint labor union in Japan now, but it is not unusual for a joint labor union to provide labor advisory service to an individual who does not belong to the union, asking the individual to join the union, and find a solution to the problem together.

日本は、いま大変な不景気で海外からの外国人労働者だけではなく、日本の正規雇用者、非正規雇用者まで一斉にだれかれかまわずに解雇されるなどの雇用不安の「真っ只中」に晒されています。


私の周囲の外国人労働者は、英語文化圏の人がむしろ少ないぐらいです。英語だけでは対処できず、中国語、ポルトガル語、スペイン語などが飛び交って困難な状況打開のために相談に対応する人たちが借り出されている事態になりました。


たんに語学ができるだけではなく、法規の知識も必要で私は語学学習の暇が無くテキストを丸暗記する日常です。、、、(^^;
